Decennial Bylaw Review: Changes Recommended by the Committee on Government Regulations
As Town Meeting approaches, we would like to share a preview of the proposed updates to Winchester’s Town Bylaws.
Winchester’s Home Rule Charter calls for a review of the Town Bylaws every ten years to ensure that they are complete, comprehensive and up to date.
The Committee on Government Regulations (COGR), a standing committee of Town Meeting with a representative from each precinct, is charged with conducting the review and recommending changes to Town Meeting.
The COGR is recommending that elements of Chapters 1-11, 13-14 and 17-18 be amended; Chapter 15 be deleted; and Chapters 12, 16 and 19-24 stand unchanged. The changes include correcting scrivener’s errors (typos), removing inconsistencies and clarifying vagaries, updating bylaws to match current town procedures, and amending the bylaws to reflect desired practices and codify residents’ rights and obligations.

Chapter 2 Town Meeting (STM Article 38)
Increase the time for posting warrants, motions, and reports from 7 to 13 days before Town Meeting. Articles with financial impacts would need to include an analysis of costs and proposed funding sources. Town Meeting proceedings would follow "Town Meeting Time" instead of “Robert's Rules,” with adjustments to the rules governing debate and motions. The Moderator would have the authority to extend speaking time for proponents.
Chapter 6 Finances and Fiscal Procedures (STM Article 43)
Require reporting of “undistributed” line item amounts by department in addition to reporting aggregate amounts for the undistributed line items (e.g., energy, insurance, personnel benefits, etc.).
Chapter 13 Wetlands (STM Article 49)
Expand the Conservation Commission’s jurisdiction to cover work in resource areas, as defined under the Wetlands Protection Act or the Town Bylaws, that may impact wildlife habitat or a resource area's ability to mitigate or adapt to climate change.
